Delivery Conditions and General Conditions of:

Ben’s Cabinemeubels v.o.f. Gildenweg 16 8304 BC  Emmeloord Holland

1. Applicability

These General Conditions are applicable to all agreements concluded with Ben’s Cabinemeubels, regardless of the terms contained in the  General Conditions of the opponent party, unless otherwise agreed.

2. Offer and acceptance

All offers made by Ben’s Cabinemeubels are valid for a period of 4 weeks. All offers and quotations by and through

Ben’s Cabinemeubels are free of obligations, unless otherwise agreed in writing by Ben’s Cabinemeubels.

3. Start of the agreement

An agreement concerning the delivery of goods and/or services is considered to be realized when the concerning order is confirmed in writing by Ben’s Cabinemeubels, or when Ben’s Cabinemeubels has started the delivery. Both parties are free to prove the realization of the agreement through other means.

4. Delivery and delivery time

All (delivery)terms mentioned in the agreement by Ben’s Cabinemeubels have been determined upon the best of his knowledge. The delivery times are only indicative and are not binding/regarded as a firm date. In case the delivery time will be exceeded, Ben’s Cabinemeubels will inform you as soon as possible. In case of force majeure Ben’s Cabinemeubels will extend the delivery term.

5. Force majeure

Ben’s Cabinemeubels shall not be expected to fulfil any obligations towards the client if it is hindered in so doing due to circumstances for which it cannot be blamed and for which it is not held responsible by either the law, a juristic act or generally accepted practice.
In addition to what the law and jurisprudence include in the definition of force majeure, in these General Conditions of Sale force majeure also refers to all external circumstances, whether expected or not, that cannot be influenced by Ben’s Cabinemeubels but which make it impossible for Ben’s Cabinemeubels to fulfil its obligations. The agreement will be dissolved.

6. Transport

Loading and unloading and transport of goods takes place at your own risk, unless otherwise agreed in writing.

Due to the high transport costs, you may not refuse the shipment under any circumstances. If necessary, we will have the shipment collected again.

If you refuse the shipment, any consequences will be yours.

7. Concerning guarantee claims 

Concerning guarantee claims you must, after a written agreement, bring the concerning article and/or vehicle to our company in Emmeloord.

Guarantee for self-installation of our products by the customer:


The product supplied by us must always be installed in the vehicle stated on the order form and on the invoice strictly in accordance with the manual enclosed by us.
If the product supplied by us is not installed in accordance with the manual supplied by us, our Warranty will be void.

8. Activities in our company

All activities carried out in your vehicle take place at own risk. Your vehicle must be insured.

9. Prices

Agreed prices are exclusive of VAT, unless otherwise agreed.

10. Payment conditions

Payment must take place within 14 days upon date of invoice or conform the terms which have been agreed and which are mentioned on the invoice.

If opponent party is in default of payment, opponent party will automatically be legally in default. Buyer has to pay interest (immediately payable) over the outstanding amount, which equals the statutory interest, concerning the period which started when the payment term was exceeded until the date the payment is effectuated. All collection fees made by Ben’s Cabinemeubels in order to collect the outstanding amounts are at buyer’s expense, unless otherwise determined by means of judicial decision. The extrajudicial collections fees  are considered to be at least 15% of the amount due, with a minimum of fl. 100,--. Above mentioned is also valid in case of bankruptcy or suspension of payment.

11. Copyright and confidentiality

The advises given by Ben’s Cabinemeubels to buyers are only applicable to the buyer himself. For publication to third parties prior permission by Ben’s Cabinemeubels is required.

Ben’s Cabinemeubels owns the copyright just like all other rights concerning intellectual and industrial property. Buyer only gets user right, unless otherwise agreed in writing.

12. Right of ownership

All goods delivered by Ben’s Cabinemeubels in accordance with this agreement shall remain property of Ben’s Cabinemeubels until opponent party has met all obligations which result from the agreement(s) with Ben’s Cabinemeubels properly. Before ownership of the products is passed to the opponent party, opponent party is not entitled to pawn the product. Under the terms of normal business buyer is entitled to sell the goods to third parties conform their use.

13. Liability

Ben’s Cabinemeubels is only liable for faults which could have been avoided, taking the carefulness and expertise into account which could have been reasonably expected. The liability of Ben’s Cabinemeubels is limited to the product’s cost price.  Above mentioned is subject to any legal liability. The buyer is only entitled to compensation if he reports the damage in writing to Ben’s Cabinemeubels as soon as possible (within 14 days at the latest).

14. Guarantee

Ben’s Cabinemeubels grants a guarantee of 12 or 24 months, under the conditions that below mentioned conditions are met. Concerning goods Ben’s Cabinemeubels gets from third parties: The guarantee granted by third parties is also applicable to the buyer. Above mentioned is subject to statutory regulations.

Warranty applies only to those who bought the product from Ben’s Cabinemeubels

Concerning visible faults: A claim must be made within 14 days upon delivery at the latest, in writing. If not, the claim will expire. Guarantee is not valid for: scratches and scrapes.

Concerning invisible faults: A claim must be made in writing (Fax, letter, e-mail) within 8 days after the fault has been detected, could have been detected or should have been detected.

In case the claim is founded the goods will be repaired, refunded or replaced, in consultation. A claim doesn’t release the buyer from his contractual obligations. Goods/articles can only be returned to Ben’s Cabinemeubels after a prior written permission. Ben’s Cabinemeubels is entitled to check the returned articles/goods and could charge reasonable research expenses and in case of refund administrative costs/banking fees.

We grant guarantee on all articles we sell (with the exception of sales items). You can only claim guarantee if you can present an invoice mentioning the concerning article. The mentioned date of this invoice equals the sale invoice date and the starting date of the warranty period. Without invoice or copy we can’t take up your complaint. The article must be delivered to our address in Emmeloord, even if we shipped them to you. Our rule: you send or bring the article to us, in case of guarantee we return the article to you, free of charge.

Scratches, spots, streaks, streaks, and minor bumps on the item that are not visible after placement in the designated vehicle are not eligible for warranty..

Cupboards, refrigerator/bed adjustments, refrigerator units, separate refrigerators, Royal Cabin covering, BCM table plateaus, TV-microwave supports, microwaves, coffee-makers, electric kettles.

1 year

Grandessa covering, converters, wheel rings, dashboards, width lamps, CB equipment

Comments, Exchange, Return shipments, Repair We treat exclusion in writing. and Warranty Application and Complaints go by our form.

15. Dissolution

Ben’s Cabinemeubels is entitled to (partially) dissolve the agreement without any obligation if:

- The buyer doesn’t meet his obligations (in time)

- The buyer applies for a moratorium or becomes bankrupt

- The buyer is a partnership and this partnership is dissolved.

In above mentioned cases the buyers is considered to be in default.

15a. Orders via our order forms can be refused when the corresponding order form is incomplete or not truthfully filled in. we will charge handling fees with repayments.

16.Taking back and exchanging delivered goods. 

Ben’s Cabinemeubels only takes back delivered goods if the reasons for it are grounded,, and after consultation. ossible conflicts will be brought before a cantonal judge. Articles can be exchanged for other articles of the same value offered by Ben’s Cabinemeubels after deducting administrative costs/banking fees. Buyer has to inform Ben’s Cabinemeubels in advance, within 14 days upon invoice date.

17. Conflicts and applicable law

Only Dutch law is applicable to this agreement.

All conflicts concerning the realization, the explanation the execution of the agreement or agreements which result from it will be brought before the district court of Utrecht, as long as it is within their competence.

17a Exchanging

Exchanging products is possible in many cases, only after written announcement (E-Mail/Letter/Fax) within 14 days upon delivery date. Only with purchase invoice, in original packing, used or damaged articles can’t be exchanged. Articles can be exchanged for other articles of the same value (or for more expensive articles, with extra payment) offered by Ben’s Cabinemeubels. We don’t credit surplus value. Possible shipping costs are at your account. Sales items can’t be exchanged.

Tip: Make a copy of the invoice and attach it to your car papers, in this case you will always have it at hand.

17b Customers

Our customers (mainly drivers and transport companies) are adult and balanced people with a responsible job, who think over a purchase and don’t make any impulse purchases. A colour or model could be disappointing, for this reason you can exchange the product. We, however, don’t return money or issue credit notes. In this way we can guarantee sharp prices.

17 c canceling orders

Cancel already paid and processed orders can only after written consent of Ben’s Cabinmeubels to the cancelling are preparation, banking, administrative and material costs., these amounts are at all times a minimum of 25% of the excl VAT price of the ordered and paid article.

18 Articles on approval

Customers are entitled to think over their purchase (approval period) during a period of at least 7 working days after having received the product. Weekends and  holidays are not included. During this approval period customers are allowed to open the package and check the product. Within the approval period customers may return the product without giving reasons / without any obligation.

You must, however, inform us in advance in writing (by the form you can find on our internet site) and comply with our shipping instructions. In case you decide to return the product, we will refund the amount paid (exclusive of shipping costs) within 30 days under the conditions you supply the correct bank details in time, in writing. The costs for shipping the package are at your account.

18a The approval period is not applicable to:

Articles which have been bought in our shop in Emmeloord

Customized and personalized articles, such as:

Customized articles (size, colour),

Customized article in uncommon colour or colour combination, 

Embroidered covering, customized cupboards, tables or other products with embroidery or engraving or leather look or textile covering in desired colour

Special size in uncommon model,

Special size textile or leatherlook,

Articles exclusively ordered for you with manufacturer, 

These articles can’t be returned after delivery and will not be taken back. Upon your order and payment and production of the article you can’t claim the amount you paid in advance anymore. These amounts must cover the costs we have to make to produce the desired article for you. We hope you  understand this. Of course we will do our utmost to make sure the desired article will meet your demands as much as possible. We guarantee the article will be delivered conform the agreement (see invoice and order form description).
